Terms & Conditions

These Terms & Conditions govern your use of the Otomate website and the services provided by OTOMATE SYSTEMS (Pty) Ltd ("Otomate", "we", "us"). By using our website, requesting a quotation, or engaging our services, you agree to these terms.

1. Our services

Otomate sets up and configures WhatsApp automation for real estate agencies, including WhatsApp Business API setup, lead capture and qualification flows, CRM setup or integration, automated follow-up sequences, and optional ongoing support.

2. Quotations and pricing

Quotations generated on our website or provided by us are indicative and are valid for 14 days from the date of issue unless stated otherwise. Final pricing is confirmed in writing after a pipeline assessment and scoping of your specific requirements. All prices are in South African Rand and exclude VAT unless stated.

3. Engagement and payment

A project begins once a quotation is accepted and any required deposit is received. Payment terms are set out in your individual quotation or agreement. Monthly retainer services are billed in advance and continue until cancelled in line with your agreement.

4. Your responsibilities

You agree to provide accurate information, the access and approvals we need to deliver the service, and to use the systems we build lawfully — including obtaining any consents required to contact your leads and customers.

5. Third-party platforms

Our services rely on third-party platforms, including Meta's WhatsApp Business API and any CRM you choose. Your use of those platforms is subject to their own terms and policies. We are not responsible for changes, outages, fees, or account actions taken by those providers.

6. Ownership and no lock-in

Systems, data, flows and automations we build for you are yours. If you end our engagement, you retain ownership of your systems and data. We retain ownership of our own underlying methods, templates, know-how and tools used to deliver the service.

7. Confidentiality

Each party agrees to keep the other's confidential information private and to use it only for the purpose of the engagement.

8. Warranties and disclaimers

We provide our services with reasonable skill and care. Other than as expressly stated, our services are provided "as is" and we do not guarantee specific results, lead volumes, or uninterrupted operation of third-party platforms.

9. Limitation of liability

To the extent permitted by law, Otomate is not liable for indirect or consequential loss, and our total liability arising from the services is limited to the fees paid by you for the service giving rise to the claim.

10. Compliance

You and we each agree to comply with applicable law, including POPIA and the WhatsApp Business Messaging Policy, in connection with the services.

11. Termination

Either party may terminate an engagement in line with the notice terms in your agreement. Accrued fees remain payable on termination.

12. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.

13. Changes

We may update these terms from time to time. The current version will always be available on this page.
